Previously a lawyer in small firms in Adelaide and a large firm in Gold Coast, Mark decided it was time to begin his own law firm in late 2019 – at the tender age of just 27 years!

Lawyer Mark Gustavsson is admitted to practice. He holds a Bachelor of Laws (Honours), Bachelor of Commerce (Accounting), Graduate Diploma of Legal Practice and is an ABRT certified Restructuring & Turnaround Practitioner.

Legal practitioners are often highly trained, experienced and qualified as they must take care of complex legal matters that arise in business and in life. Lawyers often advise clients on their rights and represent them at trials, negotiate agreements, and provide a range of other legal and advisory services.

Following his departure from the law firm on the Gold Coast, Mark decided it was time to step away from law for couple of years. Mark elected instead to study hospitality at TAFE Gold Coast and worked as a bartender, working at many of the Gold Coast’s hottest locations on the Glitter Strip.

Mark also used his time away from law to travel to China, where he studied martial arts at Kunyu Mountain Martial Arts Academy in Kunyushan, Shangdong province, winning silver in an international competition held in Taizhou province in 2016.

Mark considers his time away from practising law enabled him to return with creativity, vigor and determination.

Despite his love for the hospitality industry, Mark decided it was time to put his martial arts trained mindset to use and return to Adelaide and get back into practising law. However, this time it would be in his own name and under his own terms…

Initially working from home, Mark began to build his client base on delivering cost effective solutions. Legal professionals are traditionally thought of as being expensive and unattainable, with the working majority of people lacking the financial means to hire them.

Mark began offering his services at more affordable rates in order to be more inclusive and thus help people protect themselves from legal issues. Lawyer Mark Gustavsson ensured that those who needed representation the most, were able to afford it.

Rapid Growth of Mark’s Law Firm

Lawyer Mark Gustavsson established Mark Gustavsson & Associates to provide intelligent advice in complex commercial litigious disputes and corporate advisory. However Mark still maintains his youthful exuberance and penchant for risk taking.

Mark’s unique and contemporary approach to law is clearly working. After just two years, the firm employs 6 people and is constantly growing.

Mark is aware that the legal industry is in need of rapid evolution and he is building his business model in such a way that keeps legal advice at an affordable level, without compromising the quality of service and his own personal high standards.

Mark strongly believes the legal profession is outdated, old fashioned and overly conservative in nature. Expensive fees are often charged for ‘safe advice’ that doesn’t add true client value. Neither does it adequately challenge the traditional legal advisory model.

As the firm’s Managing Partner sub-30 years old, Mark and the team bring a youthful and creative energy to an industry which is criticised for being archaic, inefficient and stale.

Despite being a young team that is new on the block, Mark Gustavsson & Associates has established itself in South Australia and interstate as formidable litigators, powerful advocates and trusted allies. Mark’s is a law firm that’s well worth watching out for!

I wanted to establish a firm that valued creatively, quirkiness, uniqueness and wanted to build a high performance culture around those values. I hadn’t seen it done in the legal industry before but I think we’re doing it right. I like to wear my crocs around the office. I even wear them into client meetings. I find them comfortable and I think clients appreciate the candour. Sometimes I’ll even pair them with a nice airy pair of shorts. Clients seem to appreciate my casual approach as it fits in with my objective to drop the legal jargon and speak to them in plain English and simple terms.

Lawyer Mark Gustavsson – Success & Big Wins

Lawyer Mark Gustavsson was quick to defend a local Adelaide builder at a time of vulnerability and uncertainty due to the pandemic. Mark accused his client’s disgruntled customer of spreading defamatory rumours about the company which, at the time, was making headway towards turning around their business affairs. With the assistance of Business Turnaround Practitioner Eddie Griffith, the business looked as though they might emerge from financial distress. However, the defamatory rumours were causing lasting reputational damage and despite the client’s hard work he was fighting a losing battle.

Mark believes everyone should have access to legal representation. He respects the resilience of hardworking small and family business owners – especially where they’re hearts are in the right place.

Most recently, Mark Gustavsson & Associates won an appeal in the New South Wales Court of Appeal in relation to a franchising dispute with a national pizza chain. Notably, the team nabbed the win, despite having no experience in the Court of Appeal, in appeal work generally or in Sydney civil procedure.

Mark calls it pro-bono – which is also how the Law Foundation of New South Wales calls it in their Access to Justice Report titled Future directions for Pro Bono Legal Services in New South Wales.

Mark is clearly a fierce opponent and, what stands out, is that he has terrific judgement and resolve. However, at the same has a cool and level headed demeanor. Not only is Mark in full control of his emotions, he loves the ‘sport’ of a good fight and the challenge a legal battle brings!

We just hit the books, rolled up our sleeves and did the research we needed to understand how the process worked interstate. We didn’t want to be constrained by barrister’s advice, shall we say, from the ‘old-school’ generation. We were also happy to get such a great outcome for the clients on an alternative fee arrangement – where we essentially deferred our fees completely conditional upon us being successful and getting an entitlement to having our costs paid by the other side.

What’s Next for Lawyer Mark Gustavsson?

More of the same. Except that Mark has recently begun to sport a mullet (perhaps a ponytail in due course?). Armed with his crocs, Mark gives off an approachability – a willingness to challenge norms – that is distinctly unique in the legal profession. As for the firm’s business, Mark believes that if you’re constantly evolving, innovating and winning then there’s no reason to try and stick to a fixed business model. The right team members mean you’re set. Mark will continue his pro-bono and low-bono work to continue getting clients the best possible outcomes.

For those seeking Mark Gustavsson & Associates’ services, the wait might be a little longer, but his existing clients have discovered that the end result is well worth the wait. Having specialist legal guidance and an attentive team just isn’t an option most of his clients would otherwise have had access to.

Mark is also a founding member for the newly established Association for Business Restructuring and Turnaround, a not-for-profit professional association dedicated to business renewal and sustainable growth in the small to medium sized enterprise (SME) sector. Mark is a member of Business House Australia, a business support networking group. Mark is also actively involved in the In2EdAfrica, a not-for-profit which runs two schools for Kenya for underprivileged children.

 

To be able to deliver such a positive outcome for a client – and move the legal industry forward to becoming more accepting of mainstream pro bono engagements – was very rewarding on many fronts. We look forward to doing the same for many more clients to come. Many of our clients are small to medium sized businesses, but despite being small they have lofty ambitions – they just don’t necessarily have the lofty budget to afford global conglomerate level advice. We like to think we provide creative, top tier solutions to a demographic of people that has previously been excluded from legal services.

I’m really proud of the culture we are creating. We are perform to a high standard but we also have fun. The rest of the team are often encouraging me to stop wearing my crocs – but they’re just too comfortable!
